Can you legally get out of a timeshare?
Yes, in several situations. Every US state with timeshare laws gives buyers a short rescission window to cancel a new purchase, usually 3 to 15 days. After that window, owners exit through developer deed-back or exit programs, resale or transfer, a negotiated release when the sale involved misrepresentation, or with help from an attorney. Which route works depends on your contract and your state.
How long do I have to cancel a timeshare after signing?
It depends on the state where you signed. Florida allows 10 days, California 7, Texas 6, and Nevada 5, for example. Your contract must state the deadline, and that deadline is the one to follow. See our rescission period guide for more states.
Can I just stop paying my timeshare?
You can, but it carries real risk. Missed loan payments or maintenance fees can lead to late fees, collections, credit damage and, for deeded timeshares, foreclosure. Talk through the consequences for your specific contract before you stop paying anything.

What is the easiest way to get out of a timeshare?
If you are still inside the rescission period, cancelling in writing is by far the easiest. After that, a developer deed-back program is usually the simplest route for owners who have paid off the purchase and are current on fees.
Can I give my timeshare back to the resort?
Sometimes. Many large developers have deed-back or exit programs with eligibility rules, such as no loan balance and fees paid up to date. Ask owner services directly and get the answer in writing.
Will getting out of a timeshare hurt my credit?
Cancelling, a deed-back, or a sale does not hurt your credit by itself. Missing loan payments or maintenance fees can, and a foreclosure can do serious damage.
Does the timeshare rescission period include weekends?
It depends on the state. Some states count calendar days and some count business days, which skip weekends and holidays. Your contract must state the deadline, so use the date it gives.
Does the rescission period depend on where I live or where I signed?
Generally it is set by the law of the state where you signed the contract, which is often the state where the resort is. Contracts signed in Florida, for example, follow Florida's 10-day rule.
What happens if I stop paying timeshare maintenance fees?
The resort or association can add late fees, send the account to collections, report it to credit bureaus, and for deeded timeshares, foreclose. You may still owe the balance after a foreclosure in some cases.
Do maintenance fees end when the timeshare is paid off?
No. Paying off the purchase loan ends the loan payments, but maintenance fees continue for as long as you own the timeshare, and in many contracts that means indefinitely.
How can I tell if a timeshare exit company is legitimate?
Ask for the full fee, the timeline, what happens if they fail, and the refund policy in writing. Look up complaints with your state attorney general and the Better Business Bureau, confirm who actually does the legal work, and walk away from anyone who guarantees results.
Is it normal to pay a timeshare exit company upfront?
Many legitimate firms charge a fee, sometimes partly upfront. What matters is that the contract clearly states the fee, what you get for it, and whether and when you could potentially get money back. Large upfront fees paired with guarantees are a red flag.
